Lessee will build a pit run road with material excavated from the Leased Property. The <br />read will be bunt from the end of the existing access road of the leased Property known 2s Ivlesa <br />County Assessor's Office Parcel Number 2697-28400-473 to the west property line of said <br />parcel. The width of the road will be 15 feet. The pit run material will not be included in the <br />amount detezznined far royalty payment. <br />Lessee shall forward w Lcssor monthly reports showing the quantity of Material <br />removed from the Leased Property during the preceding month according to load tickets, <br />with the date of loading, The reports shall be forwarded to Lessor by the twenty-fifth (25`h) <br />day of the following month, whether matezials are removed ox not. <br />Royalties for materials removed from the Leased Property shall be due onthetwenty- <br />ftfth (25'") day of the month following the calendar month in which such material is <br />removed. All payments due to Lessor by Lessee wader this Tease shall be matte to each <br />individual Lessox in the pro zeta amount due to each individual Lessor. <br />Lessee agrees to keep a strict and accurate record of all materials removed from the <br />Leased Property and all sales thereof. LzSSOI shall havc the privilege, at reasonable times, o£ <br />examining the mining grocedures and checking the books and recozds of Lessee for the <br />purpose of verifying the amount of royalties payable. <br />IV. COVENANTS OF LE55~ <br />Lessee covenants and agrees with Lessor as follows: <br />1. To comply with all applicable laws, rules and regulations of goveznmcntal <br />authoririts, including, without limitation, the Mined Land Reclamation 13oazd of the State of <br />COlOrado, and as well to cotaply with appropriate zoning, land use, and other regulations of <br />Mesa County, Colorado. <br />2. To conduct all of its operations in accordance with the laws of the State of <br />Colorado, including, without limitations, the water laws, mining laws, and regulations of the <br />State Engineer. <br />3. To allow fire 1_essor or their officers or agents, from time to rime, to enter upon <br />alI parts of the leased premises for the purpose of inspection, surveys, tah:ng of samples sad <br />measurements. <br />4, To provide the Lessor continued access to those portions of Leased Property <br />not actually being used in mining activities of the Lessee and w accept the leased premises in <br />its present condition. <br />5. To keep the leased premises at all times clear of trash, rubbish, or junk, unless <br />prevented by extraordinary conditions or temporary breakdown of equipment. <br />
