Inclusion of this condition to permit application approval is intended to stabilize <br />the bank in the event of a flood as suggested in the Simon and Associates draft report dated June 9, <br />2000 that is included in the reclamation permit application. <br />3. The Applicant will provide legal right to enter the easements within the permit area to satisfy the <br />terms of Rule 6.4.14 of the Construction Materials Rules and Regulations of the Mined Land <br />Reclamation Board. Until Legal right to enter has been reviewed and accepted in writing by the <br />Division of Minerals and Geology, the Operator will maintain a mining setback from the easement <br />boundaries that is equal to [wo-times the depth of mining as measured as a horizontal distance from <br />the toe of the pit wall. <br />-2- <br />
