04021 Banks and Gesso, LLC <br />Exhibit M -Other Permits and Licenses <br />Additional permits and approvals required for the Wattenberg West Sand and Gravel <br />Mine are listed below. <br />Weld Countv Land Use Permit <br />The applicant is applying for a Weld County Use by Special Review permit to obtain land <br />use approval for mining and related activities at this site. <br />Weld Countv Flood Hazard Area Development Permit <br />A Flood Hazard Development Permit is not required since the site does not tie in a <br />floodplain. <br />CDPS Stormwater Discharoe Permit <br />The applicant will obtain certification under the CDPS Industrial General Permit for Sand <br />and Gravel Mining and Processing from the Colorado Department of Public Health and <br />Environment (CDPHE) and prepare the associated Stormwater Management Plan prior <br />to site disturbance. <br />Air Permits <br />The applicant will obtain Construction Permits from CDPHE's Air Pollution Control <br />Division prior to commencing site disturbance and processing activities. <br />Weld Countv Road Access and Maintenance Aoreement <br />The applicant will obtain a Road Access and Maintenance Agreement with Weld County <br />for access onto Weld County Road 6. <br />Substitute Water Supply Plan/Well Permits <br />The applicant will obtain approval of a Substitute Water Supply Plan, Gravel Well Permit, <br />and commercial well permit(s) from the State Engineer's Office (SEO) prior to exposing <br />groundwater or using groundwater for operational purposes. <br />State Historic Preservation Office <br />Please see the results of a search of the Colorado Inventory of Cultural Resources in <br />Attachment F. None of these sites are located on the subject property, <br />U.S. Armv Corps of Enoineers Nationwide Permit <br />A Nationwide permit will be obtained if required for construction of water conveyance <br />and discharge structure(s) into the Brighton Ditch or South Platte River. <br />Spill Prevention Control and Countermeasure (SPCC) Plan <br />The applicant will prepare and implement a Spill Prevention Control and <br />Countermeasure Plan if at least 1,320 gallons of petroleum products will be used, stored <br />or handled on site (as required by 40CFR112 -Oil Pollution Prevention).
