Cottony <br />Division Director <br />Natural Resource Trustee <br />DMG staff has received United Companies acceptance of the calculated Financial Liability for <br />the proposed Glen Pit. At this time it appears that all issues have been addressed pertaining to the <br />application. It is the Division's understanding that due to a lengthy scheduling process for <br />construction of the approved railroad crossing, a temporary access will be used across the <br />adjacent United permitted site of the Chamber's Pit. This arrangement is acceptable as the <br />alternate access is permitted to United and owned by the same parties of the current permit <br />application. However, the Division will require a Technical Revision to the Chamber's Pit permit <br />to reflect the impacts of the haul road on that site. If the approved rail crossing for the Glen Pit is <br />not constructed within one year of this approval letter, United will be required to submit an <br />amendment [o reflect a more permanent use of the Chamber's access. <br />The Division of Minerals and Geolo¢v is pleased to inform Lewicki and Associates and <br />United/Old Castle that the above referenced application is approved. The Financial Warranty as <br />agreed upon is set at $54,060.00. The Division prior to issuance of the permit must accept the <br />Financial and Performance Warranties.
