SPECIAL REQUII2Eh1ENTS <br />1. 1lfaterials Containment Plan (continued) <br />The foregoing provisions shall in no way render inapplicable those requirements imposed by the Federal Water Pollution <br />Control Ac[, 33 U.S.C. § 1321, regulations promulgated thereunder, [he Colorado Water Quality Control Act, and <br />regulations promulgated thereunder. It is recommended that this plan be prepared by a professional engineer registered <br />in the State of Colorado. <br />Nothing herein contained shall be construed as allowing any discharge to waters of the Stale other than throu¢h the <br />discharge points specifically authorized in this permit. Nothing herein contained shall be construed as excusing any <br />liability the permittee might have, civil or criminal, for any spill. <br />The submittal of a Spill Prevention Control and Coun[etmeasure Plan (SPCC Plan) as required by 40 CFR Pan 112 may <br />satisfy all or part of this requirement. Should additional materials exist on site which are not addressed in the SPCC <br />Plan, addressing those materials as per the above is required. <br />I/ I( there is no such material present at the site, this shall be indicated in writing and submitted to the Division for review. <br />2/ If there is material present but the perminee feels there is not a reasonable probabiliry of a spill impacting waters of the State. this shall be documented in <br />wnnng and submitted to the Division for review. This documentation shall include; 1) distance to nearest su r(ace waters, and: 2) a deeded descripnon or <br />any stmeture which prohibits the release of material onto the ground or into a conveyance system. <br />E. GENERAL MONITORING, SAMPLING AND REPORTING REQUIRE?\fENTS <br />1. Routine Reuortine of Data <br />Repotting of the data gathered in compliance with Pan [.B.l shall be on a ouarterly basis. Repotting of all data <br />gathered shall comply with [he requirements of Pan I.E. (General Requirements). Monitoring results shall be <br />summarized for each calendar quaner and reported on Division approved discharge monitoring report (DMR) forms <br />(EPA form 3320-1). The forms shall be mailed to [he agencies listed below so they are received no later than the 28th <br />day of the month following the end of [he quaver (for example, the DMR for the first calendar quaver must be received <br />by the Division by April 28th). If no discharge occurs during the reporting period, "No Discharge" shall be repotted. <br />The DMR forms consist of four pages -the top "original" copy, and three attached no-carbon-required copies.
