Long <br />Divi>ion Director <br />On July 7,'2000, DMG received correspondence from the BLM Uncompahgre Field Office, dated <br />July 7, 2000, regarding access to federal minerals at the High Mesa Gravel Pit, located in portions <br />of the NW %. of Section 4 and NE '/a of Section 5, T15S, R94W, 6`h PM, Delta County, Colorado. <br />The BLM correspondence indicated that the applicant, Beavers Construction, had not yet been <br />granted access from the BLM to remove federal minerals from the referenced location. <br />Pursuant to C.R.S. 34-32.5-1 15(4)(d), DMG is prohibited from approving the permit application <br />until the applicant can verify right of entry, from the BLM, to extract the federal minerals. DMG <br />will address the right of entry to extract the federal minerals as an adequacy issue of the <br />application. <br />The BLM correspondence was received prior to the close of the public comment period of the <br />application. DMG interprets the BLM correspondence as a statement of opposition to the approval <br />of the permit application. However, BLM personnel have indicated that BLM is not opposed to the <br />approval of the application, providing the applicant secure a sales contract with the BLM prior to <br />removal of the federal minerals. <br />Please review the enclosed /nforma/ Conference Package, typically provided to all parties and <br />objectors to an application.
