Please find enclosed, copy of the BLM correspondence, dated <br />July 7, 2000. Pursuant to Rules 1.4.5(3) and 2.7.1(1-(c), DMG decision date has been <br />moved up to August 10, 2000, to allow time for the Pre-hearing Conference to occur at <br />least five working days prior to the Board Hearing and ensure that the Board Hearing <br />occur prior to the 120'h day of the application. <br />Please be advised that the High Mesa Gravel Pit application may be deemed inadequate, <br />and your application may be denied on August 10, 2000, unless the following adequacy <br />review items are addressed to the satisfaction of DMG. Should the applicant need <br />additional time, beyond the August 10, 2000 decision date, to respond to these adequacy <br />issues, please request an extension to DMG's decision date and extension to the 120"' <br />day deadline, required by Rule 1.4.513-, prior to the August 10, 2000 decision date. <br />ADEQUACY ISSUES <br />1. Proof of Publication Please submit proof of publication of the public notice <br />required by Rule 1.6.2(1)(d1,1g) and 1.6.5. <br />2. Exhibit D -Mining Plan, Rule 6.4.4 The Mining Plan does not appear to contain <br />a timetable sufficient to establish the relationship between mining and reclamation <br />during the different phases of the mining operation, as required by Rule 6.4.4(e). <br />Please clarify whether the operation will be phased, with concurrent reclamation <br />being completed for each phase, or if the operation will affect the entire 48 acres <br />prior to initiating reclamation. DMG reclamation cost estimation is based upon the <br />maximum affected area to occur at any given time. Therefore, a phased operation, <br />which limits the total unreclaimed acreage, generally results in a significantly lower <br />R G eg E.
