" (Diane & Thane Anderson- September 21, 1998) <br />DMG Response: A number of wetlands aze currently noted on the Tellier property. Only <br />one wetland will be impacted at the road crossing. The applicant has stated in the permit <br />that a 404-Permit will be obtained from the U.S. Army Corps of Engineers. The <br />construction of wetlands on reclaimed lands will mitigate some of the potential impacts <br />of the proposed gravel operation. The applicant is required to construct wetlands that <br />thrive under the proposed reclamation plan and in accordance with the 404-Permit. The <br />reclamation performance bond can not be released for this azea until the wetlands are <br />properly constructed and vegetation has established. <br />"...It is importan[ that sufficient frnancial and legal means be in place to ensure [he <br />correct day [o day operations and long term recovery plans are curried out... (David & Janet Bradley- October 23, 1998) <br />DMG Response: The applicant has provided the Division with a mining and reclamation <br />plan that meets the minimum requirements of the Construction Material Rules and <br />Regulations of the Colorado Mined Land Reclamation Board and the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials. The applicant is required <br />to post a performance warranty and a financial warranty in the amount of $80,000.00 <br />prior to mining to ensure reclamation of the site is performed in accordance with the <br />Rules and the approved permit. <br />The Construction Materials Rules & Regulations address the obligations of the <br />applicant to comply with the permit, enforcement actions and penalties for non- <br />compliance. <br />5.
