<br />PRESENTATION <br /> <br />Eleven issues were raised by the objectors to be considered for approval/denial of the <br />application by the Division and are noted on page 3 of the Draft Hearing Order. <br />Five issues raised by the objectors are not to be considered by the Division and are listed <br />on page 4 of the Draft Hearing Order. <br />The specific questions are attached to the Draft Hearing Order. <br />Division's response to each question can be found in the document titled, Rationale for <br />Recommendation for Aoaroval Over Objections <br />Issues Raised by the Objectors & Division's Response; <br />1. Is the legal description accurate and complete (Rule 6.4.1)? <br />(Anderson, 9/21/98), (I) <br />DMG Response: 10/26/98 The applicant provided the correct legal description for <br />the proposed gravel pit, which is the NE '/< of the NW '/ of Section 17. The <br />exhibits and maps have been updated with the correct legal description. <br />2. Are the Pre-Mining and Mining Plan maps complete and accurate (Rule 6.4.3)? <br />(Anderson, 9/21/98), (5)&(6) <br />"The haul road shown in Map 3 shows the length of the existing ranch road !o be <br />approximately 200 feet rather than the staled length of npproxirnately 165 jeer. " (Diane <br />& Thane Anderson- September 2/, 1998) <br />DMG Response: Map #3 titled, Tellier Grave] Pit Mine Plan Map, depicts the haul road <br />starting from Routt County Road 33A and leading to the pit area. The haul road is <br />included in the affected permit boundary and is depicted on the map. The map reveals <br />the actual location and distance of the haul road and meets the minimum requirements of <br />the Rules and Regulations. <br />"The paragraph slates that office and maintenance buildings exist and to our knowledge <br />they do not exist and do not appear on any plan showing the existing buildings. " (Diane <br />& Thane Anderson- September 21, 1998) <br />DMG Response: The office and maintenance buildings are noted in the permit text and <br />included on Map #3, and this meets the minimum requirements of the Rules and <br />Regulations. <br />
