V. PRE-HEARING CONFERENCE - REbIAINING ISSUES
1. Whether the Colorado Mined Land Reclamation Board has the authority to issue a rrtining and
reclamation permit to the applicant in the absence of prior approval of a Conditional Use permit
from Adams County.
2. Whether the proposed land uses of mining, water storage, and wetlands aze consistent with
Commerce City and Adams County's comprehensive land use plan for residential use of the
proposed affected land.
3. Whether disturbances to the First Creek floodway and floodplain will be minimized during
mining and reclamation.
IV. STAFF RECOMMENDATION
Mobile Premix Concrete, Inc. has resolved all adequacy items raised by the Division and all
comments/concerns raised by the objectors that are within the authority of the Colorado Mined
Land Reclamation Board as specified in the Colorado Land Reclamation Act for the Extraction
of Construction Materials, Sections 34-32.5-10] et sec., C.R.S. (1999). The Division
recommends that the Board approve the Mobile Premix Concrete, Inc. 112 Permit Application
for the Tanabe Pit over objections and post a financial warranty in the amount of $1,105,900.
