- " ~ • III IIIIIIIIIIIIIIII ~ <br />MINUTES, Page 4 - Mey a5~ 19~r3 - ML Ra Meef~~5 <br />AGENUA ITEM 5 - FORMAL PUBLIC HEARING - PROWERS COUNTY COMi~1ISSIOtIERS <br />All persons wishing to give testimony in this matter, Files No. 77-387 <br />and 17-414, were sworn by the chairman. <br />Staff presentation was made by Reclamation Specialist Supervisor, Joe <br />ZalKind, regarding two unpennitted operations operated by the Prowers <br />County Commissioners. They are currently under cease and desist order. <br />Applications have been received by the division on both operations. <br />The matter before the board at this• time is to consider civil penalties. <br />The board was presented with ATTACHidENT B, letter dated May 23, 1983, from <br />'William E. Beggs, to 14r. Robert Temple, Board of Prowers County <br />Commissioners. The board was also given a chronology of events that led <br />to the current situation. <br />Slide presentation was made by.8rad Janes as a result of afield <br />inspection made on March 4, 1983. <br />The County Commissioners were present, Mr. Joe Hasse r, Mr. Carl Windsor, <br />City Administrator, Mr. Robert Temple and t4 r. Darrell Seufer, each <br />responding to the various issues involved. <br />After considerable discussion it was MUVEU that the board assess a civil <br />penalty of $1,000 with $750 suspendedif the two applications are <br />approved within 9U days. SECUNUEU. <br />After further discussion among the board members the motion was withdrawn. <br />It was MOVED that the matter of Prowers County Commissioners be continued <br />until the applications are deemed adequate and are before the board for <br />consideration of approval or denial and that the civil penalty be assessed <br />at that time. SECUNDEU and PASSED by a Vote of 6 for (Blach, Holder, <br />Slade, Hullinyhorst, O'Connor and Barry)/1 opposed (Winter). <br />BOARD MEMBER, Davis Holder, left the board meeting. <br />AGEt1DN ITEM 6 - FORMAL PUBLIC HEARING - ANDREWS SAND AI1D GRAVEL, 74-113 <br />All persons wishing to give testimony in this matter were sworn by the <br />chairman. <br />Staff presentation was made by Reclamation Specialist Supervisor, Joe <br />Zalkind, regarding two unpennitted operations. Violations were found and <br />cease and desist orders were issued by the board at the April meeting. <br />Total disturbance of 15 acres and two separate sites. The operations are <br />approximately 3.5 miles north of Bethune in Kit Carson County. An old <br />
