<br />obligation of parties of the second part to maintain said above
<br />described right-of-way roadway shall be limited to an expense which is
<br />in proportion to their use of said roadway.
<br />Together with all easements and rights-of-way appurtenant thereto, ail
<br />improvements thereon and all fixtures of a permanent nature currently
<br />on the premises except as hereinafter provided, in their present
<br />condition, ordinary wear and tear excepted.
<br />Together with all and singular the hereditaments and appurtenances
<br />thereunto belonging, or in anywise appertaining, the reversion and
<br />reversions, remainder and remainders, rents, issues and profits
<br />thereof; and all the estate, right, title, interest, claim and demand
<br />whatsoever of the said party of the first part, either in law or
<br />equity, of, in and to the above bargained premises, with the
<br />hereditaments and appurtenances.
<br />TO HAVE AND TO HOLD the said premises above bargained and described,
<br />with the appurtenances, unto the said parties of the second part, the
<br />survivor of them; their assigns and the heirs and assigns of such
<br />survivor forever; subject to easements and restrictions of record,
<br />unrecorded easements, claims of easements or encroachments, if any,
<br />and building or zoning laws and ordinances; and subject further to:
<br />1. License Agreement (Evergreen File No. B-8034), dated
<br />September 25, 1975, between CF&I Steel Corporation and The
<br />Valley Metropolitan Recreation District, granting a license
<br />to construct, reconstruct, operate and maintain two 50 foot
<br />towers, with television aerial, along with transmission
<br />lines. located in the NE1/4 of Section 29, Township 33
<br />South, Range 63 West.
<br />2. Sublicense Agreement (Evergreen File No. 6-8557), dated
<br />October 7, 1980, between Valley Metropolitan Recreation
<br />District and the University of Southern Colorado, KTSC/TV,
<br />granting a sublicense of approximately 100 feet square in
<br />the NE1/4 of Section 29, Township 33 South, Range 63 West
<br />for the purpose of transmitting television signals. (See
<br />above license).
<br />3. License Agreement (Evergreen File No. B-5734), dated
<br />September 13, 1963, between The Colorado Fuel and .Iron
<br />Corporation and Raton Natural Gas Company, granting the
<br />right to lay, construct, reconstruct, replace, renew,
<br />remove, maintain and operate an 8-inch diameter pipe line
<br />for the transportation of gas across lands located in Las
<br />Animas County, Colorado.
<br />And the said party of the first-part, for itself and its-successors,
<br />covenants and agrees to and with the said parties of the second part,
<br />the survivor of them, their assigns and the heirs and assigns of such
<br />survivor, the above bargained premises in the quiet and peaceable
<br />possession of the said parties of the second part, the survivor of
<br />them, their assigns and the heirs and assigns of such survivor,
<br />against all and every person or persons lawfully claiming or to claim
<br />the whole or any part thereof, by through or under the said Party of
<br />the first part, and CFB.i Steel Corporation, to WARRANT AND FOREVER
<br />DEFEND.
