Jay James, Tom Lel dlch, and John <br />Pellicer were also on the site at several critical occasions during the constcuctton of <br />this pond, as well. Their summary report for This project is located in Addendum 13-12A- <br />D. I, Michael G. Altavilla, am a 1994 graduate in mining engineering and I have been a <br />Registered Professional Enginee[ in Colorado since August 17, 1992. <br />The purpose of my inspection and certiflcat ion was to ensure proper construction of <br />uu^edimentation Pnnd 012 and to satisfy the requirements of Rule 4.05.6~10~ of the Colorado <br />Mined Land Reclamation Board. The material was placed Sn the embankment to meet or <br />exceed the design speclfi cations (see Addendum 13-12A-E for compaction information. <br />This as-bull[ [eport confirms the construction of this structure meets or exceeds the <br />Rules and Regulations of the Colorado Mined Land Reclamation Board. The structure rs <br />stable, evidencing no indications of slope instability. <br />To the best of my knowledge, based upon my pro fesslonal expertise, and [o [he extent <br />pos sl bl e, Pnnd D12 at the Yoast Mine was constructed in acco tdance with the prudent <br />state-of-the-art methods for earthen embankment construction. Further, the structure was <br />covet ruct ed in compliance with the approved design, to the extent possible, as specified <br />in Attachment 13-12 0[ Seneca Coal Company's approved mine permit.
