Capitalized <br />terms used herein shall have the same meaning provided for them in the Plan. <br />In support of this Modification the Committee would show the Court that Section 16.1 of the <br />Plan provides that the Proponent (the Committee, as defined in Section 1.97 of the Plan), reserves <br />the right in accordance with Section I l27 of the Bankruptcy Code to modify the Plan at any time <br />before confirmation. Section 1127(a) of the Bankwptcy Code provides that the Proponent may <br />modify a plan at any time before confirmation so long as the plan, as modified, meets the requirements <br />of Sections 1122 and 1123. <br />The Committee submiu that the modifications proposed herein do not affect the recovery of <br />any creditor or other parry in interest in these Cases except such creditors as have consented or aze <br />expected to consent, in writing, to the modification.
