Box 276 <br />Elizabeth, CO 80107 <br />RE: MILLER-BERENOS PIT <br />Dear Mr, Harold Hurst: <br />We have received your application for a t4ining & Reclamation Permit far your <br />gravel, sand, and rock operation in Elbert County. Our initial review <br />indicates that all preliminary items required by the Colorado Mined Land <br />Reclamation Act, CRS 34-32-101, et seg., have been submitted; thus your <br />application has been deemed complete on this date. All review and discussion <br />time periods initiate from this date. <br />The tentative date for consideration of your application by the Mined Land <br />Declamation Board is October 23-24, 1985. You should commence publication of <br />a notice of the filing of this application accordingly (see enclosed nr. ice <br />format). Because the date for consideration may be subject to revision, <br />please do not include it in your notice. <br />In addition to publication of the newspaper notice, you must mail a copy of <br />the notice after first publication to all owners of the surface rights of the <br />affected land and to the owners of record of immediately adjacent lands. You <br />must provide proof of the notice and mailing, such as Certified Mail Return <br />Receipt Requested, to the MLR staff before your application can be considered <br />by the Mined Land Reclamation Board. <br />You must also place a copy of this application for public review, less <br />confidential items, with the Elbert County Clerk and Recorder. Any subsequent <br />changes or additions to the copies on file in our offices must also be made in <br />this local government copy. <br />The Mined Land Reclamation Board recommends that all mine operators check <br />compliance of their mining operation(s) with State water law.
