• -11-
Dick Ward: Could I ask one preliminary question?
Sadler: Please do.
Dick Ward: If thi3 thing has been going on as Mr. Spillers said from 1971' to
1580, why .have the residents not notified someone prior to July 16,
1580?
Sadler: Tt.e residents have. The residents have informed the Mined Land
Reclamation district, and unfortunately, two telephone calls, finally
after numerous telephone calls with McArdle, Bob and Jim Scltmieding,
wc~ have discovered
that there are laws which protect us, and unfortunately I'm not an
attorney and I just didn`t know that there were in fact laws that
protected us. I went to the County Commissioner's when they opened
ttie Fit up, when I lived there, and they said there was nothing I
could do. At that point I tried to go to the EPA; the SPA came down
artd within a couple that Mr. (names unintelligible) wore out there,
they closed down. Okay? I went to the Health Department, the Health
Department came down, they looked at the pit, the Health Department
itt Durango was unable to comment on the pit, they said they didn't
have any jurisdiction over events in Crand Junction. He came down,
had a cup of coffee with r. he operator who was a friend of his prior
to this inspection, he called me back and said `it was legal. I called
h:im and asked for a complete set of regulations and he sent me a
ra_gistered letter which included a ease and desist order on the
previous owners, the previous operators to P1r. Spillers.
