State Req.
• concentration of 0.11 mg/I at NPDES 003, all maximum concentrations
reported are below the recommended criterion; the maximum recommended
lead concentration for lead in livestock water is 0.10 mg/I. Table 7-10-5
presents data for the Classification and Numeric Standards for the Yampa
River Basin as published by the Colorado Department of Health Water
Quality Control Division (1980). Little Grassy Creek is tributary to the
Yampa River between the Elk River and Elkhead Creek -Stream Segment 12
of the Yampa River. As can be seen, there are no numeric standards for
inorganic chemicals or metals in this reach of the Yampa River Basin. The
only criterion of interest is pH which must be between 6.5 and 9.0. The
range in pH listed in Tables 7-10-I, 7-10-2, and 7-10-3 are within this
range. Thus, it is concluded that the water in the impoundments will he
adequate for the intended postmining land use and will not exceed the
numeric standards for the receiving stream.
4.05.9.1 The water level in both impoundments will be maintained by the through
• (b) flow of Little Grassy and Grassy Creek. Flow to the Northwest Impound-
ment will be the flow now measured at site SW-S2-2. Flow to the Wade
Impoundment will remain the same as now measured at NPDES 002.
Streamflow data at these three sites are contained in the 1982 and 1983
Seneca II Mine annual hydrology reports. Figures 7-10-1 through 7-10-3
summarize the flow data collected at these three sites since September of
1981. The data indicate that there should be ample water to sustain the
water levels in these two ponds.
4.05.9.1 Livestock and wildlife access to the ponds will be assured by not fencing off
(c) any areas around the ponds. The postmining land users desire the water
availability as is demonstrated by the letters in Addemdum 7-106. The
water rights for the Wadge Impoundment, as listed in Table 7-41 of Permit
C-005-80, is for 220.0 acre-feet per year with an appropriation date of
December I, 1976. The water right for the Northwest Impoundment is for
1.6 acre-feet with an appropriation date of June 29, 1977. Both water rights
were appropriated on November 20, 1979. Peabody Coal Company, the
• owner of these water rights, will transfer them to postmining land owners as
part of any land sale.
7-10-6 Revised September 28, 198
