This pertains to the application approval reaffirmation request by Fountain Colony
Investment Company.
Note that they have no objections to the proposed action. They also indicate a desire to review
the final plan prior to actual mining. This seems to be an appropriate consideration, provided
their review can be handled in an expedited fashion. [t is suggested that, in the event an
amendment to the permit is not required prior to the initiation of operations, that
representatives of the operator, whoever that might finally be, and the Soil Conservation
District meet for aperson-to-person type of discussion, perhaps even on site. Of course if the
permit needs an amendment prior to starting operations, the Soil Conservation District will
have the opportunity to review the entire amendment as a part of the normal process.
Respectfully,
Mark A. Heffner
cc: R.D. Von Engeln
Dean Sams, EI Paso County SCD
