WI~REAS, tho Colorado Mined land Reclamation Act, C.R.S. 34-32-101 gt sue. (the "Act"), as
amended, and tho Colorado Land Reclamation Act for the ExtrsetioD of Cooatruction Materials,
C.RS. 3432.5-101 ~~• (the "Act's, as atnatded, provides that nopemtit may be iaslted under theAct until the
Mined band Reclamation Board (the "Bolud'~ receives a plafotTna3tce wttrratlty (or warranties) that is a written
promise to comply with all applicable requirements of the Act.
WHEREAS, J q- ~ ~ ~' ~ r'U,ye-~ (the"Opetarot"~hasappluedforapenrlit to
conduct a mining operation lrnown as S f~.cs,;~n~ A 1~- (the "Operation") on certain
loads in ~-f'¢ ti~ Coutriy, Co[or~o. These lands are described in the permit application, as
amended and supplemented, and are referred to herein as the "Affected Lands".
WHEREAS, in its applicatiott for the permit, the Operator has agrrxd to be bound by all requirements of
the Act and ell applicable rules and regulations of the Board, as amended from time to time.
WHEREAS, the Board has determined, in accordance with the Act, tfiat the estimated costs of
reclamation with regard to those affected lands iD f~~•~f'a"f Cotmtywhicharerowormaybeoome
subjec! to the permit are those amounts for the stated periods of tune as set forth in the financial warranty, which
may be amended from time to time to reflect revised estimates of said costs of reclamation.
