Johnson of Johnson Excavation, Inc, last week, wherein <br />the commitment was made that we requested until Monday 9 November 1998 to supply this <br />information. The purpose of this letter is to address the additional concerns identified in Ms. <br />Crosby's letter and supply you with the information requested in that letter. In order to ensure <br />that each of the concerns found in her letter is addressed, we will restate her concern and offer <br />our response <br />DMG Concern: 1. Two easement holders were notified of the operation on October 17, <br />]998. The applicant will seed to obtain a written waiver from the Yampa Valley Electric <br />Association and US West of their right to the 41 day comment period. If the applicant is <br />unable to obtain written waivers, the decision date will need to be extended an additional <br />41 days to allow for comments. <br />Response: Enclosed are comment letters from both the Yampa Valley Electric Association and <br />US West Communications saying they have reviewed our proposed development plans and that <br />this operation will have no effort oa utility operations or their easements. These letters also state <br />that these are the final comments they will have regazding this matter. <br />2. The applicant has provided docamentation of an agreement with Pablic Service <br />Company to install strain gauges and provide monitoring of the gauges by Public Service <br />Company. The applicant further commits to provide copies of the strain gauge reports to <br />the Division. The plan is acceptable, but must be clearly described in the permit. The <br />Division saggests that the applicant provide copies of all strain gauge data with each <br />annual reclamation report, with the exception of cases where unacceptable strains are <br />detected by the gauges. In this case the Division, must be notified within 24 hours after the <br />applicant has knowledge of the problem (Role 8.1). The Applicant must farther commit to <br />maintenance of a minimum 200-foot setback from the pipeline until the strain gauges are <br />installed and initial readings recorded. <br />Response: The Applicant has prepared a new Permit Application page, numbered page 9a which <br />specifically addresses these concerns. <br />3. The applicant states that there is a remote potential for nine percent of the mine are [sic] <br />to potentially lower the elevation of the Anderson's well since the bottom of the pit floor is <br />below the elevation corresponding to their well. The Division agrees with the applicant that <br />there is a remote potential for the proposed mining operation to adversely affect the <br />Anderson's well because of the deptb and location of the pit in relation to the well. <br />
