The Pemrittee, Aggregate Industries - WCR, Inc. desires to corded a mining operation (mown <br />as E 8th Street Operation, for the purpose of extradmg Sand and gravel. The Pemlittee will nar mine any <br />secondary commodities at this site. <br />B. On November 21, 2000 the Mined Land Reclamation Board (the "Board") approved the <br />Pertnittee's application for this permit, fixed the amourrt of the financial wartarlty and directed that this permit be <br />issued upon the Sling with the Division of Minerals and Geology (the "Division's of perfomrance warranty and <br />financial warranty (or warranties) in the amount so fixed m form and substance approved by the Division. Said <br />warranties have bear filed with the Division. <br />C. Tf the Pemii[tee desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On November 21, 2000 the Board made the following Sndutgs: <br />1. The application for this pemrrt complies with the regrriremettts of the Colorado Muted <br />Land Reclamation Act for the Extraction of Conswction Materials, C.R.S. 34-32.5-101 et sue., as amended, and <br />with all appbcable local, state and S'deral laws; <br />2. The operation will oar adversely affect the stability of any significant, valuable, and <br />permanent man-made s[mdure located wither two hlmdred S'et of the Affected Land, except where there is an <br />agreemem between the Operator and the persons having an intemst m the stmcture that damage to the structure is <br />to be compensated for by the Perntittee; and; <br />
