Dear Mr. Austin:
The Division of Minerals and Geology received the amendment to the application for the
addition of the access /haul road to the permit area on July 14t'', 2004. Tha amendment
documentation also includes RG Gonsulting's response to other issues noted in the April
21 ~t, 2004 Preliminary Adequacy Review. Per Rule 1.8 the following must occur when
filing an amendment to an application:
(1) Applicant must file a copy of the amendment with this Office and place a copy with
the County Clerk and Recorder.
(2) Within five (5) working days of placement with the County Clerk and Recorder, the
Applicant shall provide this Office with an affidavit or receipt demonstrating that
the amendment was placed with the County Clerk and Recorder not later than the
close of Business on the day the amendment was filed with this Office.
(3) Any amendment to an application shall constitute a new filing for the sole purposes
of determining the date for consideration by this Office, and for a final decision on
the application. The Provisions of Rule 1.6.6 shall apply to the submitted
amendments.
(6) Within five {5) working days of the filing of an amendment to an application, the
Office
shall set a new date for the consideration of the application pursuant
Subparagraph
1.6.6.
The Division considers the amendment filed as of July 14`", 2004. RG Consulting should
deliver to DMG staff the required affidavit from the County Clerk and Recorder no later
than July 21", 2004. The Division, per Rule 1.8.1(6) and 1.6.6, has set the new Decision
Date for September 13"'. 2004. The applicant must begin the Public Notice procedure no
later than July 26r'', 2004. A copy of the published notice would be appreciated as soon
as publication begins.
