Faries, Recorder <br />LEASE AGREEMENT <br />31st day of December , 197 6, by and between HARLEM T. <br />THIS LEASE AGREEMENT is made and entered into this <br />~'ooic <br />~~ <br />I•. l'Y <br />8~3_ <br />JACKSON, whose address for the purpose of this Agreement is in <br />care of Jackson Development Co., 608 East 11th, Delta, Colorado <br />81416, hereinafter referred to as Lessor, and CORN CONSTRCiCTION <br />CO., a Colorado corporation, whose address for the purpose: of <br />this Agreement is Box 1240, Grand Junction, Colorado 81501, <br />hereinafter referred to as Lessee; WITNESSETH: <br />HTIIEREAS, Lessor is the owner of the following described <br />real property in the County of Delta, State of Colorado, to-wit: <br />• PARCEL 1. Part of the Northeast Quarter of the <br />Southwest Quarter of Section 7, Township 15 South, <br />Range 95 West of the 6th Principal Meridian <br />described as follows: Beginning at the North- <br />east corner of the Northeast Quarter of the <br />Southwest Quarter of said Section 7, thence <br />West 32 and 32/34ths rods, thence South 16 rods <br />and 6 and 1/2 feet, thence West 24 rods, thence <br />South 17 rods and 10 feet, thence West to the <br />Northeast corner of the Kepler Tract which is <br />a distance of 123.203 feet more or less, thence <br />South 46 rods to the South line of the Northeast <br />Quarter of the Southwest Quarter of said Section <br />7, thence East to the Southeast corner of the <br />said Northeast Quarter of the Southwest Quarter, <br />thence North to the point of beginning; AND <br />PARCEL 2. The Northwest Quarter of the Southeast <br />Quarter of Section 7, Township 15 South, Range <br />95 West of the 6th Principal Meridian; and <br />WHEREAS, the said property contains sand and gra~~el, and <br />the parties desire to lease the premises so that Lessee mar extract <br />• such sand and gravel therefrom; <br />NOW, THEREFORE, this Agreement witnesseth that: <br />1. Lessor hereby grants unto Lessee the exclusive right <br />to enter upon the real property above described and to extract, <br />process, stockpile and remove therefrom sand, gravel and topsoil. <br />2. Lessee agrees to proceed with due diligence rind make <br />application to the Colorado Land Reclamation Board for the issuance <br />
