A, As noted in attached materials, two stages of "reclama- <br />tion" are involved at the Snyder. Rampart-~-rerican, snder State law <br />(C.R.S 1973; 34-1-301 et. seg. and C.R.S. 1973; 24-65.1-101 et. seg.) <br />cannot obtain building permits for permanent structures over the <br />commercial limestone deposit which underlies its surface ownership <br />until the master plan of the City of Colorado Springs has provided <br />for the safe extraction of the commercial deposit. No such knc-an plan <br />exists for this tract, which adjoins the 80-acre Snyder site, although <br />the deposit is in the E1 Paso County and State inventory. See the E1 <br />Paso County tdineral Inventory P•laps of John H. Lecais in cocperation <br />with E1 Paso County Land Use Cepartment dated February, 1975 on file <br />in the Land Use Office. <br />Castle owns the limestone and mineral rights underlying <br />the Rampart surface ownership caith the specific reservation in the <br />mineral owner to use "so much of the surface as is convenient". (No <br />application is pending on this mineral ownership by Castle). <br />The proposed final use as a public park would require <br />slopes safe for public park use. In order to be dedicated to a govern- <br />mental authority, the terrain will be required to be in an acceptable <br />condition. <br />B-1. The 27-acre affected site, as shown in the Map k:xhibits <br />and Supplemental Exhibits, was surface disturbed, first in the 1890's <br />or early 1900's, then by Castle pre-July, 1973.
