Ed Byrne, P.C.
A Professional Legal Services Corporation
2338 Broadway, Suite 300
Boulder, CO 80304 - 4107
June 5, 2004
Thomas A. Schreiner
Environmental Protection Specialist
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203
RECEIVED
JUN 0 8 2004
Division of Minerals & Ceolopy
Re: `~ Response to Adequacy Letters T Bone Stone Quarry,110c Construction n
Materials Application File M-2004-030, Request for Extension C'/ass ~ PP/'r>ri~
Dear Tom,
I met with Bill Tenore today and we have revised the enclosed Exhibits C, D, and E and the
Reclamation Plan Map to correct and clarify our original submittals. Revised language is underlined
in order to make the changes more apparent. The primary clarification relates to the amount of
overburden and topsoil found on the site. Top soil is negligible, averaging no more than 4 inches in
depth across the site (approximately 5,326c.y.). The overburden ranges from 0 to 2 feet across the
site, with an average depth of 1 foot (approximately I5, 968c.y.}.
A misunderstanding occurred (probably my error) because the overburden will be used to create the
final slope of 3:1 and, in order to fill in a few selected azeas where highwalls may remain after
quarrying ceases, overburden depth after reclamation may be 10-15 feet. However, the quarry
operation itself will extract stone from the center of the quarry to the edge at close to the 3:1 slope
in order to reduce the amount of overburden needed to complete the final reclamation. We have
adjusted the reclamation cost calculations accordingly.
We will use broadcast seeding, so we have adjusted the revegetafion cost per acre upwazds to
$400/acre (including trees and grasses) in order to more than account for the doubled grass seed rate.
Grass reseeding using the broadcast method will occur in the spring when reclamation begins, but
it is not anticipated that the 7-8 acre disturbed azea of the initial quarry will be ready for cessation
of quarrying activities for 25-30 yeazs. Bill believes there currently exists about 2001inear feet of
10-12 foot highwalls, but the express goal of our revised reclamation plan will be to cut the length
of highwalls in half to no more than a total of 1001ineaz feet, with maximum heights of 5 to 8 feet,
an improvement of current conditions on the site.
In your letter dated May 27, 2004, you asked that our responses be submitted on or before June 11,
2004, in order by provide the Division of adequate time to review the revised application prior to the
June 16, 2004 decision date. You should receive the revised Exhibits, Reclamation Plan Map, and
a copy of a receipt from the County Clerk and Recorder showing that the revisions have been filed
therewith on June 8, 2004. However, in the event additional time is required by the Division to
decide whether to grant Mr. Tenore's T Bone Stone 110c Application, Mr. Tenore has authorized me
to request at this time that the Division extend the Decision Date for 30 days to July 16, 2004.
Land Us¢ & Development Planning -Mediation & Facilitation -Government & Pnblic Relations
Phone: 303.447.2555 ti FAX 303.447.1635 4 Voice Mail: 303.637.4972 v email: edbymepc@aoLcom
