If for filly reason there shall be default on <br />the part of Lessee, and Lessee shall fail or refuse to <br />comply ca.ith any of the terms or provisions hereof, then, at <br />tl7e option of Lessor, Lessor may give notice .j,n wri.ting to <br />Lessee of such default specifying.the nature and character <br />thereof, and unless the default shall be corrected o;ithin <br />ninety (90) deys after the receipt by the Lessee of such <br />notice, then, at the option of Lessor, this Lease and all <br />rights thereunder of Lessee shall be terminated ~.nd Lessee <br />shall quietly and peaceably surrender t-he said premises unto <br />Lessor. <br />18. At any time during the term of this Lease, <br />Lessee may terminate by delivering possession of the premises <br />to Lessor, paying to Lessor any unpaid royalties due him and <br />by delivering to Lessor a recordable instrument of surrender. <br />19. The parties acknowledge hereto that it is in <br />their mutual benefit to attempt to expand the area covered <br />by the Special Use Permit above described and each agree to <br />cooperate in sucks effort; provided, however, that the costs <br />of any such application or procedure shall bey borne by <br />Lessee. <br />20. Lessee agrees to keep accurate books of account <br />showing the operations and particularly the amount of material <br />removed, and to permit a representative of Lessor to examine <br />-9- <br />
