(Lafarge) has prepared the following responses to the objection letter from the <br />lawyers for Jane and Ervin O'Dell. This response will address each point in the same order as the <br />O'Dell's letter. In addition, Lafarge has also prepazed a response to your question concerning the <br />stability analysis of the Suttle Ditch. Our responses are as follows: <br />1) The significant changes are as follows: <br />a) Increased amount of settling-pond wetlands from 10 to 17.41 acres <br />b) Minimal increase in groundwater lake area from 64 to 6S.S9 acres <br />c) Greater retention (i.e. less disturbance) of existing wetland areas <br />d) Greater visual and wildlife aesthetics by creation of S lakes rather than 1 lake <br />e) Movement of the Process area and Batch plant from the north end of the <br />property to the south end of the property (i.e. farther from the existing <br />neighbors) <br />2) As I indicated, I was unaware of the pre-agreed to 40-acre maximum disturbance. <br />Lafarge will abide by this condition of the original permit as a continuing condition of <br />our amended permit. The calculated reclamation costs, as presented in EXHIBIT L, from <br />the Amendment Application is virtually the same $270,199 as those presented in the <br />original permit application. The existing reclamation bond for the site is $270,200. Even <br />though Lafarge will be disturbing an additional 12 acres as compared to the existing <br />permit during the life of the operation, the reconfigured mine plan for the property has <br />resulted in only 1.6 additional acres of groundwater lakes area, 3 additional acres of <br />shoreline, 7.41 additional acres of backfilled/wetland replacement areas, and 11.26 <br />additional acres of undisturbed lands. The existing permit has 79 acres of the lOS acres <br />that are disturbed.
