IE Lessor <br />the right to make <br />payment. otherwise <br />fails to make any such payment, Lessee shall }i~vc <br />the same and deduct it from any subsequent <br />due hereunder to Lessor. <br />TA};ES AND ASSESSMENTS: Lessor agrees to pay promptly all taxes <br />and assessments levied against the demised premises or any part <br />thereof during the entire term of this Lease, except such as are <br />attributable to mining operations conducted by Lessee on such <br />property. If Lessor fails to make such payments, or if tViere are <br />any taxes or encumbrances now due on such real property or any part <br />thereof, Lessee may pay tl~e same and any penalties thereon, or <br />redeem such property from tax sale, and deduct the amount expended <br />from any royalties thereafter accruing. <br />CONFLICTS L9ITH OIL AND GAS AND GTHER MINERAL LEASES: The <br />rights granted to Lessee hereunder do not include mining rights <br />with respect to oil, gas, and other minerals. Eiowever, Lessor <br />agrees that any operations to remove oil, gas, or other minerals <br />shall not interfere with mining operations of Lessee, except as <br />provided in any existing Leases, and Lessee is hereby given sole <br />reasonable discretion~to determine whether or not such operations <br />interfere with or will interfere with the mining operations of <br />Lessee. <br />INC];DENTAL PROVISIONS: At the termination of this Lease, <br />either zit the end of the term or by cancellation or surrencer prior <br />thereto, Lessee shall have the right to remove all of Lessee's <br />buildings, structures, machinery, equipment, and other property <br />from an}~ part of the demised premises within sixty days thereafter. <br />The terms and provisions of this Lease shall be binding on and <br />inure to the benefit of the parties, there heirs, legal <br />representatives, successors and assigns. <br />Lessee shall not assign this Lease to any person, firm or <br />corporation without the prior writteci consent of Lessor. <br />Lessee shall comply with all applicable laws, including <br />reclamation, and obtain all necessary 13'ermits. <br />All notices may be served in person, or may be given by <br />registered or certified mail, return receipt requested, postage <br />prepaid, addressed to the party at the last known address and <br />payments may be made by Lessee's check mailed to Lessor's address <br />until Lessor shall notify Lessee of a change of address. <br /> <br />-3- <br />
