doing business at P. O. Box 1007, City of Canon City, County of
Fremont, State of Colorado, herein referred to as Lessee.
In consideration of the sum of Ten~DOllars paid to l~im by
Lessee, receipt of which is acknowledged, the royalties reserved
lie rein, and the covenants and conditions contained herein, Lessor
Hereby leases to Lessee, for the purposes set forth herein, all
sand and gravel contained in and lying on and under the
following-described real property in Fremont County, State of
Colorado, containing forty acres, more or less:

MIIQING RIGHTS: Lessee shall have the exclusive right to mine,
extract, and remove all ecomonically recoverable sand and gravel in
or und~:r the demised premises for the exclusive benefit and use of
Lessee, and to conduct such mining operations by such method as
Lessee shall determine.
Le:>see shall have the unrestricted right to use the surface and
subsurl'.ace of the demised premises for any purposes in connection
with it.s mining operations on such premises. The right granted
Lessee hereunder shall include, without limitation, all mining
rights, privileges, franchises, and immunities of every kind and
nature whatsoever that are necessary or covenient, or that Lessee
in its judgment shall deem to be necessary or convenient, for.
carrying on mining operations, or for mining, extracting and
removing, all sand and gravel contained in or under the demised
premises.
Lessor shall retain the right to graze cattle on the demised
premises so long as it does not interfere with Lessee's operations.
TERM: Lessee shall hold the demised premises during the term
of ten (10) years from date of issuance of the Mined Land
Reclamation permit.
EYPLORATION OF PREMISES: Lessee shall have the exclusive riyl[t
to enter on the demised premises and to explore, prospect, drill.,
or otherwise test the same for sand and gravel, with the right of
free access for such persons, tools, machinery, and equipment as
Lessee may deem necessary at any time aEler the date l~cre~E.
