Banks and Gesso, LLC
Exhibit S -Permanent Man-made Structures
Permanent man-made structures located within 200 ft of affected areas are as follows:
1. Nyberg Road -Pueblo County
2. Overhead Power Lines -Aquila, Inc.
3. Overhead Transmission Lines -Public Service Company of Colorado
The applicant has been in contact with Pueblo County, Aquila and Public Service
Company. Structure agreements, an easement release application (with Southern
Colorado Power, now Aquila), and encroachment application (with Public Service) are in
progress. Please find attached proof that structure agreements have been mailed to all
structure owners.
Based on the use of adequate setbacks and because no blasting operations will be
performed, it is not anticipated that the proposed mining operations or reclamation plans
will adversely affect the stability of these structures. Notarized agreements or a slope
stability analysis will be obtained prior to mining within 200 feet of these structures.
St. Barbara Sand and Gravel Mine 03028
Trans Colorado Concrete 35 February 19, 2004
