To allow for settling, the constructed height of the sedimentation <br />• embankment will be at least 5 percent greater than the designed height. <br />All construction will be accomplished according to design and applicable <br />regulations. The sedimentation pond embankment and surrounding areas <br />disturbed by construction will be seeded after the embankment is <br />completed. The active upstream side .of the embankment where the water <br />will be impounded will be riprapped or otherwise stabilized. Areas in <br />which vegetation is not successful or, where rills and gullies develop, <br />will be repaired and revegetated. <br />The sedimentation pond will remain in place after the termination of <br />mining activities. The pond will not be removed until the disturbed <br />area is reclaimed, and herbaceous cover of the revegetated area complies <br />with the standards set forth in Section 4.15.10. <br /> Peerless Resources will examine the sedimentation pond periodically to <br />• ensure that the pond is in good, safe working condition. <br />4.05.7 Discharge Structures <br />Discharge from the sedimentation pond will be controlled by the use of <br />an energy dissipater and flow check devices where necessary.
