As explained <br />to men the proposed operation would involve no permanent structures. <br />Chapter 2, Section 2-102 of the San Juan County Land Use Code specifically <br />exempts mining activity from the provisions of our land use regulations <br />until such activity involves construction of a building. San Juan County <br />is not zoned at the present times therefore mining is an allowable activity <br />and land use. <br />As presently planned Mr. Benham's proposed mining operation is in compliance <br />with all applicable San Juan County regulations.
