SHELTO N, Direotor <br />DATE: August 8, 1986 <br />T0: Gregg Squi r/e~ <br />FROM: Dale Plume \ `J~ <br />RE: FINDINGS OF RESPONSE TO STIPULATION NO. 1 REQUEST FROM EMPIRE ENERGY <br />"E" SEAM DEVELOPMENT WORK <br />Explanation of Findings <br />Pursuant to Rule 2.07.6(2)...Rule 2.07.6(2)(m) are discussed under the <br />appropriate discipline subtitle, compliance is required as per Rule 4,05 for <br />the Hydrologic Balance: Ground Water - Pule 2.04.5, 2.04.7, 2.05.3(4) and <br />4.05.10, 11 and 12 <br />The Stipulation is as follows: <br />STIPULATION N0. 1 <br />• PRIOR TO ANY REMOVAL OF COAL AS A RESULT OF DEVELOPMENT WORK IN THE "E" SEAM, <br />EMPIRE ENERGY MUST P.ECEIVE THE APPROVAL OF THE MINEC LAND RELLAJMTION DIVISION <br />FOR EMPIRE'S PLAN TO MONITOR ANY DECREASES IN THE GROUND WATER INFLOW RATE <br />INTO THE N0. 5 MINE DIRECTLY ABOVE AND CONTIGUOUS TO THE HORIZONTAL AREA <br />REPP,ESENTING THE MINE AREA FOR THE N0. 6 ttINE DEVELOPEMT 4(ORK. <br />THIS INFLOW SHALL BE MEASURED ON A REGULAR BASIS (TO BE AGREED UPON BY <br />DISCUSSION WITH MINED LAND RECLAMATION DIVISION REPRESENTATIVE) PRIOR TO N0. 6 <br />MINE DEVELOPMENT WORK AND DURING DEVELOPMENT iJORK. IF IT CAN BE DEMONSTRATED <br />THAT NO SIGNIFICANT INFLOW EXISTS, THIS STIPULATION WILL BE ELIMINATED. <br />Empire Energy requests that this stipulation be eliminated due to the <br />following facts: <br />1. The 1986 No. 5 Mine Inflow Study, performed ,tune 19, 1986, showed there <br />is no measurable inflow within 500 feet of the portion of the No. 5 dine <br />overlaying the planned "E" coal seam access and development area. <br />2. The expected .total inflow to the "E" coal seam access and development <br />area is 7.0 gpm. This volume amount is too small to try and detect by <br />measuring changes in the total inflow to the No. 5 Mine, which produces <br />600 to 700 gpm. <br />3. Since the "E" coal seam access and development area is in the vicinity of <br />the subcrop of the "E" coal seam, as well as the subcrop of the "F" coal <br />. seam, it is expected that both seams are unsaturated in most of the area <br />approved for the "E" coal seam access and development.
