Technical Revision Application to Permit C-044-81; <br />• Access to E Seam <br />February 14, 1986 <br />Page 3 <br />therefore, still be less than 3% of 20.5 cfs, the estimated 7-day 10-year <br />low flow for the Williams Fork River. <br />The maximum impacts of the discharge of the E Seam water on the Williams <br />Fork and Yampa Rivers should be very similar to that calculated in the No. <br />5 Mine and No. 9 Mine Permit document. This estimate determined that the <br />combined permitted discharges from the No. 5 and No. 9 Mines (3,000 gpm) <br />would not change the utility of the surface water for agricultural <br />purposes. The combined flows of the No. 5 Mine and the E Seam mine are <br />not expected to exceed the 3,000 gpm used in the calculations in the <br />permit document. <br />This Technical Revision application consists of two major sections, <br />"Revisions" and "Reference Material". <br />The "Revisions" section is made up of those portions of the presently <br />approved permit document which have been modified to address the <br />activities planned in the access to the E Seam. The revised pages have a <br />revision date of 2/14/86 on the bottom left-hand corner. All modified <br />material has a slash mark (/) on the left side of the page at the line <br />• which has been modified for this technical revision. <br />The "Reference Material" section contains portions of the presently <br />approved permit document (narrative , figures and tables) which are <br />referenced in the "Revisions" section of this application, but have not <br />been modified for this revision application. The "Reference Material" is <br />.presented with this application in order to expedite the review process. <br />Empire Energy Corporation recognizes that the approval of this technical <br />revision application in no way obligates the Colorado Mined Land <br />Reclamation Division (CMLRD) to approve any future production activity in <br />the E Seam. Any production activity planned in the E Seam will be <br />submitted to the CMLRD (and OSM if applicable) as a new permit application <br />or a permit revision to the presently approved permit document. <br />Production activities within the E Seam will not be conducted prior to the <br />approval of such activity. <br />Please contact me if you have any questions concerning this material. <br />Sincerely, <br />D.
