<br />February 14, 1986 <br />Mr. Gregg Squire <br />Colorado Mined Land Reclamation Division <br />423 Centennial Bldg. <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />RE: Technical Revision Application to Permit C-044-81; <br />Access to E Seam <br />Dear Mr. Squire: <br />• The enclosed Technical Revision is being submitted to your agency to <br />receive approval for Empire Energy Corporation ("Empire") to conduct rock <br />slope development to the E Seam and restricted development work within the <br />E Seam. The planned activities propose no new surface disturbance and <br />will be conducted within the presently approved permit boundary of Permit <br />No. C-044-81. <br />Meetings were conducted with your agency as well as with the Office of <br />Surface Mining (OSM) to determine the most practical and expedient means <br />of compliance with existing statutes. OSM determined that all reviewing <br />and approval responsibilities belong to your agency, since the planned <br />activities do not include mining of federal coal or surface activities <br />taking place on public lands controlled by the federal government. OSM <br />does expect copies of all activities approved by your agency inorder to <br />maintain current documentation for their files. Empire will comply with <br />OSM's request by submitting the appropriate number of copies of the <br />technical revision material, fallowing approval of such material by your <br />office. <br />The major concerns raised by your agency during our January 3rd meeting <br />included potential effects that the planned activity would have on the <br />groundwater, the possible hydrologic impacts that may be anticipated if or <br />when production activities take place in the E Seam, and the stability of <br />mpire Energy Corporation <br />PO DOH 60 ORnIG GOIOAADO 6626 <br />I]0]~ 82+~B2a6 <br />
