NOI CX-2005-227-00) <br />Dear Mr. Burnell: <br />Thank you for your timely review and comments on our recent NOI submittal for our Big Elk <br />Property. The following respond to the two comments raised in your comment letter: <br />1) Rule 4.07.3 states that an abandoned drillhole "shall be marked". The applicant indicates <br />that GPS coordinates will be recorded. The Division requests that, in addition to the GPS, <br />that a physical marker be placed on the abandoned drillhole. This can be something as <br />simple as a brass cap marker at ground level. <br />Response: Juniper Coal Company (JCC) will provide a simple permanent marker at ground level, <br />with identifying number, to mazk the location of each borehole. The NOI text has been modified <br />to reflect this commitment (copy attached for your reference and file). <br />2) Secondly, the applicant has provided a selection of seed mixes for various land uses, but has <br />not indicated which land use is appropriate for the disturbed sites. Please indicate which of <br />the seed mixes is proposed. The Division has concerns about the seed mix listed for <br />pastureland. <br />Response: Conversations with the local permitting contact (John Weinman) for the Hayden <br />Gulch Mine property indicate that the proposed drill-sites all fall within the boundaries of the HG <br />reclaimed area, which is designated for a dual postmining land use of rangeland/wildlife habitat. <br />Therefore, the Rangeland/Wildlife seed mix will be utilized in reclaiming the proposed drilling <br />disturbance. The NOI text has been modified to reflect this clarification (copy attached for your <br />reference and file). <br />I have contacted our bonding coordinator, who will secure the necessary surety documentation <br />and forward it directly to Johanna Cramer. A copy of the NOI will be filed, consistent with <br />public access requirements, at the Routt County Courthouse this week, and required progress <br />reports will be prepazed and filed as project work proceeds. <br />We appreciate your consideration and cooperation in facilitating timely review and approval of <br />this submittal.
