/SSUES RAISED AFTER THE INITIAL COMMENT PERIOD <br />No addition issues have been raised after the initial comment period. <br />ISSUES RAISED DURING THE INITIAL COMMENT PERIOD THAT THE DIVISION <br />BELIEVES ARE NOT WITHIN THE JURISDICTION OF THE DIVISION OR BOARD <br />1. "Noise, dust, truck traffic and visual impacts" -Items 1,2,3,4,5,9 and 10 of the objector's June 25, 2002 letter. <br />Response -The DMG has no authority over noise, truck traffic or visual issues, the County may have some control <br />over these issues. The DMG does have some control over loss of soil from topsoil stockpiles through erosion, the <br />applicant has committed to stabilize these stockpiles 6y seeding them. Other dust issues should be addressed to the <br />State Air Pollution Control Division. <br />2. "The application states that the access road a public road, yet we pay a lease to the State Land Boazd to use that road <br />as do our neighbors, the Noonans." -Item 6 of the objector's June Z5, 2002 letter. <br />Response - The only portion of this issue that the DMG has any control over is to insure that the applicant has a <br />legal tight of access.
