<br />Figure 2.03.4(1)(c)-1 (con't) <br />' , fferences with wor!:men, riots, disorders, civil distw:bances, <br />fires, explosions, storms, floods, landslides, washouts, labor ~snd <br />material shortages, boycotts, inr_erruptions to transportation, <br />' embargoes, acts of military authorities, acts of local, state oz <br />' federal agencies or regulatory bodies, court actions, arrests and <br />restraints, ar.d without limitation by enumeration, any other cause <br />' or causes not reasonably wit}rin the control and without the fault or <br />negligence of. the party in default which wholly or partly prevent <br />' the producing, processing, and delivering of the coal by OPERATOR or <br />' the receiving, transpor`_ing, accepting, or utilizing of coal by <br />ATLANTIC RICHFIELD or its coal purchasers. <br />&. Effect Hereunder: <br />If, because of Force Majeure, either party hereto is unable <br />~o carry out any of its obligations under this Agreement, and iE <br />' such party shall promptly give to the other party written notice of <br />such Force ;•lajeure, then the obligation of the party giving such <br />' notice shall be suspended to the extent made necessary by such Force <br />' Majeure and during its continuance, provided, however, that the <br />party giving such notice shall use its best efforts to eliminate <br />1 such Force Majeure insofar as possible with a minimum of delay. <br />Nothing herein contained shall cause the party affected by the Force <br />Majeure to submit to an unfavorable labor agreement, and it is <br />agreed that any settlement of labor strikes or differences wit`: <br />workmen shall be entirely within the sole discretion of the affected <br />' party.
