Long <br /> <br />M-99-025, Receipt of Objection Sent to County Pl Division Director <br />anner <br />The Division of Minerals and Geology (DMG) received the copy of your letter of objection, sent to <br />the Mesa County Planning Department, that itemizes your concerns regarding approval of the <br />conditional use permit for the proposed Soaring Eagle Gravel Pit. Though the letter is not <br />addressed to DMG, we must clarify whether or not it is your intent, by copying the letter to DMG, <br />that this letter be considered to be an objection to the application for reclamation permit. To help <br />you determine if you wish this letter to be considered an objection to the reclamation permit <br />application, I have provided the following clarifications and comments. <br />DMG regulates reclamation aspects of mining operations. The operator must demonstrate that <br />the proposed gravel pit site can be reclaimed to a beneficial use and they must indicate how <br />reclamation will be performed. Prior to issuance of a permit, DMG requires a reclamation bond for <br />reclaiming the site, per the approved reclamation plan. <br />Your concerns addressing: <br />• Road impacts; <br />• Traffic and pedestrian safety; <br />• Hours of operation; <br />• Noise pollution; <br />• Air pollution; <br />• Speeding; <br />• Zoning; <br />do not appear to fall under the jurisdiction of DMG. These concerns, with the exception of air <br />pollution, are typically under the jurisdiction of local government such as Mesa County andlor <br />City of Grand Junction. Air pollution is regulated by the Colorado Department of Public Health <br />and Environment -Air Pollution Control Division. <br />Because your letter was not addressed to DMG, but was copied to DMG, it is unclear if you are <br />filing an objection to the reclamation permit application, submitted to DMG. If you are filing a <br />complaint to this application, DMG's rules and regulations require us to initiate a process of two <br />conferences in the Grand Junction area and a Formal Public Hearing, in Denver, before the MLRB. <br />Please be aware that DMG and the MLRB cannot restrict, or require an operator to perform or <br />modify certain activities that are not under our jurisdiction. <br />
