Box 25 <br />Montrose, CO 81902 <br />Dear Mr. Million: <br />DMEA is aware of and hereby grants permission to excavate gravel <br />in the area of our 46kV line located north of West LaSalle Road. <br />This grant is addressed to hiz•. Aaron F. ;3illion with the <br />following conditions: (1) Vehicular access must be maintained, <br />(2) address and administer procedures to..avoid present and future <br />erosion. DMEA has no problem with mining within the 200' <br />perimeter, if the two above requests can be maintained. The 96kV <br />line crossing your property is a vital link of power to the <br />Olathe area and would effect many customers if failure were to <br />occur. <br />This grant is conditional upon Mr. Million's adherence to the <br />above mentioned requests. If these requests are not followed, <br />this gr--ant will terminate upon a 30 day written notice by DMEA to <br />Mr. Milli-on. <br />Presently, relocation of the 96kV line on the Appelhanz property <br />is in design. Fuld work has yet to be completed but removal of <br />the pole noted in your letter will not be a part. of this <br />relocation. If you have concerns as to the present pole <br />locations being in conflict with mining operations we need a <br />request from you for re-location. of existing facilities. This <br />request would need to be addressed soon in order to coincide with <br />the r-e-design work presently being done on the Appelhanz <br />property. DMEA will not relocate existing facilities foi file <br />benefit of those requesting relocation. Therefore, all costs for <br />design, material and labor would be an up front fee and non- <br />refundable. <br />If you have future questions as to said request, I may be reached <br />at 290-1297.
