PART I
Page No. 7
Permit No. COG-850000
:B. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
2. Stormwa[er Management Plan (SWMP) (continued)
• c. Erosion and Sediment Controls - Describe BMPs that will be used to reduce erosion and prevent sediment delivery to State
waters. These should include structural (such as silt fences, sediment ponds, drop structures, check dams) and non-
shuctural (such as mulching and revegetation) methods.
Whenever a facility or a portion of a facility enters the post-mining phase, it is likely that the overall configuration of the
site will change considerably. Prior to the rime when new vegetation becomes established, the surface areas will be subject
to potentially significant erosion. The pemvttee will need to take adequate measures in order to minimize this erosion as
well as the erosion normally encountered during mining activities.
d. Identification of Dischazges other than Stormwater-The stormwater conveyance system on the site shall be evaluated for
the presence of discharges other than stormwater, such as mine drainage, spoil springs, sanitary waste, or process water of
any kind. The SWMP shall include a description of the results of any evaluation for the presence of discharges other than
stotmwater, the method used, the date of the evaluation, and the on-site drainage points that were directly observed during
the evaluation.
b) Facility Inspections
Qualified personnel identified by [he operator shall make a comprehensive inspection of their stormwater management system, at
least twice per yeaz (in the spring and fall), except as provided in paragraphs d and a,below. These comprehensive inspections must
be documented and surmnarized in the Annual Report (see Part LD.2. of the permit).
1) Material handling areas, disturbed aeeas, areas used for material storage that are exposed to precipitation, and other potential
sources ofpollution identified in the SWMP in accordance with Part LB.2.a)1) of this permit shall be inspected for evidence of,
or the potential for, pollutants entering the drainage system. Structural stormwater managementmeasures, sediment and control
measures, and other structural pollution prevention measures identified in the plan shall be observed to ensure that they aze
operating correctly. A visual inspection of equipment needed [o implement the plan, such as spill response equipment, shall }
• made. .
2) Based on the resultsoftheinspection,thedescriptionofpotenfialpollutantsourcesandpollutionpreventionmeasuresideutified
hr the plan shall be revised as appropriate within two weeks of such inspection. Such revisions shall provide for implementation
of any changes to the plan in a timely manner, but in no case more than 90 days after the inspection.
3) A report sumr„a,;>ing the scope of the inspection, personnel making the inspection, the date(s) of the inspection, major
observations relating to the implementation of the SWMP, and actions taken in accordance with paragraph (b), above, shall be
made and retained as part of the S WMP for at least three years. The report shall be signed in accordance with Part LD.7. of this
pemut,
4) Where semi-annual site inspections aze shown in the plan to be impractical for sites where an employee is not stationed or does
not routinely visit the site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan,
but never less than once in two yeazs.
5) Where semi-annual site inspections aze shown in the plan to be impractical for inactive sites (sites where industrial activity is no
longer conducted), site inspections requiredby this part shall be conducted at appropriate intervals specified in the plan, but, in
no case less than once in three years. At lease one site inspection required under this part shall be conducted before October 1,
1999, or the date two yeazs after such site becomes inactive, whichever is earlier.
c) Additional SWMP Requirements
1) Signatory Requirements: A copy of the plan shall be signed in accordance with Part LD.7. and retained on site.
2) SWMP Review/Changes: Upon review of the S WMP, the Division may notify the pemtittee at any time that the plan does not
meet one or more of the minimum requirements of this pemrit. After such notification, the permittee shall make changes to dte
plan and shall submit to the Division an update [o the plan including the requested changes. Unless otherwise provided by fire
Division, the permittee shall have 30 days after such notification to both make the necessary changes to the plan and i
. implement them
