Walther
Executive Director
Ronald W. Cottony
- Acting Division Director
On September 18, 2002, the Mined Land Reclamation Board issued an Order directing the
Division and Fremont county to correct a "clerical error" at the Fremont County pit. Following is
a list of items that the Division and county are required to do in order to complete the correction
process:
1. The Fremont County pit, M-1984-117, will be re-activated. All correspondence, requests,
annual reports and fees, etc. will, from here on, refer to the pit as the Fremont County pit
with the DMG permit number M-1984-117 (the original permit). Fremont county must
place a correct mine ID sign at the entrance of the permit area pursuant to requirements of
Rule 3.1.12.
2. Fremont county must adequately delineate the permit boundary of permit M-1984-117 (as
delineated in the original permit). The site will be inspected once the correction process is
complete.
3. The Coaldale pit, M-1978-096, has been terminated. All of the correspondence dated after
1990 (annual reports etc.) has been transferred into the M-1984-117 file. This includes the
recent amendment request (see below).
4. The new possible illegal, M-2002-083, has been terminated. AlI of the documents have
been transferred to the Fremont County pit, M-1984-117.
If the county still wishes to expand the M-1984-117 pit, via the recent amendment
application, please notify the Division within 90 days from the date of this letter so the
process can be re-activated. A new application fee will not be required. However, new
notices will need to be mailed out since the permit number will have changed. As part of
the technical review, the application form and exhibits will need to be corrected and re-
submitted to reflect the correct pertnit name and number. The county may want to waive
the right to a 30-day decision so the review process is not interrupted because of certain
time constraints.
