Cottony <br />Division Director <br />Natural Resource Trus[ee <br />The decision date for the above referenced application is May 1, 2006. Please be advised that <br />the application may be deemed inadequate and may be denied on May 1, 2006, unless the <br />following adequacy review items are addressed to the satisfaction of the Division. <br />Adequacy Issues <br />The application indicates that topsoil is intermittent and too shallow to warrant salvage <br />for reclamation purposes. However, sufficient soils exist to support the pre-mining <br />Pinyon/Juniper community and the operator has chosen rangeland post-mining land <br />use, which requires a final vegetative cover. Please clarify how the operation will <br />comply with the requirements of Rule 3.1.9. Please clarify how the operation will <br />attain a rangeland vegetative cover, compliant with the requirements of Rule 3.1.10, <br />without the benefit of topsoil replacement. <br />2. Pursuant to Rule 6.4.5(1) and 6.4.5(2)(f)(v), please specify the minimum depth or <br />range of depths for replacement of topsoil and/or earthen material sufficient to support <br />vegetative cover. Please ensure that the application clarifies how the anticipated <br />replacement depth will provide sufficient root depth for the proposed vegetative cover. <br />The application indicates that explosives will be utilized. Pursuant to Rule 6.4.4(i) and <br />6.5(4), please submit the appropriate analyses which demonstrate that off-site areas <br />will not be adversely affected by blasting. DMG recommends that the analyses <br />address all structures within one mile of the permit boundary. <br />4. The application indicates that the final slope of the benched 36-foot highwall shall <br />approximate 0.6H:1 V. Pursuant to Rule 3.1.10(3), final slopes must support <br />rangeland post-mining land use and shall not be too steep to be traversed by <br />livestock.
