<br /> <br />Minutes, May 23-24, 1990 <br />PAGE 5 <br />General, clarified that this bond could be forfeited on June 1, 1990, <br />if, at that time, the company has not complied with the December Letter <br />of Agreement. <br />This issue will be reviewed and probably resolved at the June Board <br />Meeting. <br />Staff Presentation by Sandra Brown: <br />FORMAL PUBLIC HEARING <br />oa u e-ma ing. <br />All persons wishing to give testimony were sworn. <br />Consideration/adoption of changes to existing rules and regulations of <br />the Colorado Surface Coal Mining Act, Article 33 of Title 34 C.R.S. <br />The rule amendments have been proposed pursuant to the authority <br />granted in 34-33-109 C.R.S. The petition for rule-making was presented <br />to the Board on March 21, 1990. <br />Staff presented EXHIBIT A - a May 23, 1990, memo to the Board <br />requesting adoption o e Coal Rules; the Coal Rule-making package was <br />also presented in that Exhibit. Staff stated that a few minor <br />editorial changes had been made to the package, since its initial <br />presentation to the Board in March. <br />Rule 4.05.6(3)(e), the provision that would allow certain spillways to <br />-be grandfathered from the new design standards, had to be withdrawn <br />from the package, because OSM would not approve this Rule. Discussions <br />will continue between Division Staff and OSM regarding this Rule. <br />Staff stated that no comments were received from industry or other <br />interested parties, regarding these Rules. Staff answered questions <br />from the Board. <br />It was MOVED that the Board approve this package of proposed Rules and <br />authorize prortulgation of the Rules.
