<br />Minutes, May 23-24, 1990 PAGE 2 <br />Staff stated that this application was received on February 26, 1990, <br />and was found to be complete on March 8, 1990. Public Notice began on <br />March 27, 1990, during which time the Division was informed of a <br />problem with the Public Notice, regarding the legal description. The <br />Public Notice was started again on April 26, 1990, with the last day <br />for this Notice being May 24, 1990. The public comment period ends on <br />June 13, 1990. <br />Division Staff completed an adequacy review on May 15, 1990, for this <br />application. The Division identified eighty-eight items as needing <br />clarification by the operator in the adequacy review. Staff referenced <br />the letter in Attachment A to the Board from the operator's attorney in <br />which the 90-day decision date was waived. The Board was informed that <br />the operator's intent was to request that a public hearing be held <br />during the July 1990 Board Meeting, and the 120-day decision date will <br />also be waived by the operator. <br />In response to a question from the Board, Staff stated that the <br />deficiencies sited in the adequacy review related to the mine plan, <br />hydrologic issues and the reclamation plan. Staff further answered <br />questions from the Board. <br />Mr. Thomas A. Young, an attorney representing the operator, explained <br />the status of the application, with regard to local government. On <br />behalf of the operator, Mr. Young requested the Board schedule this <br />issue fora Formal Public Hearing for the July Board Meeting. He <br />answered questions from the Board. <br />Staff informed the Board of 3 options, regarding this issue: 1) <br />consideration of the permit at this time, 2) continue the consideration <br />of this application to the June Board Meeting and hold a hearing at <br />that time and 3) set this issue for a Formal Public Hearing for the <br />July Board Meeting at this time or schedule it, during the June Board <br />Meeting, for a Formal Public Hearing for the July Board Meeting. <br />Mr. Frank Johnson, Assistant Attorney General, addressed the issue of <br />the timing of the application, i.e., in regard to deadlines for <br />approval. He stated that, at this time, the Board could grant or deny <br />the permit or set the issue for a Formal Public Hearing for the July <br />Board Meeting, as requested by the operator. <br />Ms. Jan Wilkins, Chairperson of the Canyon Defense Coalition--an <br />organization composed of families in that area whose purpose is to <br />protect Clear Creek Canyon, addressed the Board. She related concerns <br />regarding the mining and reclamation plans for this operation. Ms. <br />Wilkins answered questions from the Board. <br />The Board discussed this issue in some detail. Mr. Johnson asked h1r. <br />Young to submit, in writing, a waiver of the 120-day approval deadline, <br />and he agreed to do so. <br /> <br />r <br />It was MOVED that the Board continue this issue to the June 1990 Board <br />Meeting.
