Section 616.74 (f) Continued. <br />• (g) Terraces shall be constructed on the outslope if required for <br />control of erosion or for roads included in the approved postmining land <br />use plan. Terraces shall meet the following requirements: <br />(1) The slope of the outslope between terrace benches shall not exceed <br />lv:2h (50 percent). <br />(2) To control surface runoff, each terrace bench shall be graded to a <br />slope of 1v:20h (5 percent) toward the embankment. Runoff shall be <br />collected by a ditch along the intersection of each terrace bench and <br />the outslope. <br />(3) Terrace ditches shall have a 5-percent slope toward the channels <br />specified in paragraph (f) above, unless steeper slopes are necessary in <br />conjunction with approved roads. <br />• Energy Fuels will not have any hard rock spoil and therefore will <br />not construct any fills according to the more lenient regulations <br />of 30 CFR 816.74. <br />Section 816.79 Protection of underground mining. <br />(a) No surface coal mining activities shall be conducted closer than <br />500 feet to any point of either an active or abandoned underground mine, <br />except to the e>:tent that -- <br />(1) The nature, timing, and seeuence of the operations are jointly <br />approved by the regulatory authority, the Pfine Safety ape Health Admini- <br />stration, and the State agency, if any, res?onsible for the safety of <br />mine workers; and <br />(2) The activities result in improved resource recovery, abatement of <br />water pollution, or elimination of hazards to the health and safety of <br /> <br />816-103 <br />
