Section 826.71 (n) Continued. <br />• and MSHA upon the basis of a plan submitted under 30 CFR 784.25. <br />Energy Fuels will not be returning any excess spoil to <br />underground mine workings <br />Section 816.72 Disposal of excess spoil: Valley fills. <br />Valley fills shall meet all of the requirements of Section 816.71 and <br />the additional requirements of this Section. <br />(a) The fill shall be designed to attain a long-term static safety <br />factor of 1.5 based upon data obtained from subsurface explora*. ion, <br />geotechnical testing, foundation design, and accepted engineering <br />analyses. <br />Excess spoil fill No. 1 and excess spoil fills No. 2a and 2b are <br />• all classified as valley fills. In general, the ground surface <br />) in the bottom of the proposed spoil areas are relatively gentle. <br />However, small portions of the valley sides are steeper than 20° <br />and thereby classify the structures as valley fills. The designs <br />presented in Exhibit 9, Excess Spoil, are based on the results of <br />exploratory borings, observations made in the field, and other <br />geotechnical investigations made by CTL/Thompson, Inc. and repre- <br />sent a long-term static safety factor of at least 1. 5. <br />(b) A subdrainage system for the fill shall be constructed in accor- <br />dance with the following: <br />(1) P. system of underdrains constructed of durable rock shall meet the <br />requirements of 2aragraph (b)(4) of this Section and: <br />(i) Be installed along the natural drainage system; <br />• (ii) Extend from the toe to the head of the fill; and <br />816-95 <br />
