Section 816.71 (j) Continued. <br />of underdrainage systems, (3) installation of surface drainage <br />systems, (3) placement and compaction of fill materials, and <br />(4) revegetation. Within two weeks of the inspection, a report <br />from the inspector certifying that construction is proceeding <br />according to the approved design will be sent to the regulatory <br />authority. Energy Fuels will keep a copy of this report on file at <br />the minesite. <br />(k) Coal processing wastes shall not be disposed of in head-of-hollow <br />or valley fills, and may only be disposed of in other excess spoil <br />fills, if such waste is -- <br />(1) Placed in accordance with Section 816.85; <br />(2) Demonstrated to be nontoxic and nonacid forming; and <br />• (3) Demonstrated to be consistent with the design stability of the <br />fill. <br />Energy Fuels will not generate any coal processing waste as a <br />result of the surface coal mining and reclamation operations which <br />are the subject of this application. Energy Fuels will, therefore, <br />not be placing any coal processing waste in any fills. <br />(1) If the disposal area contains springs, natural or manmade water- <br />courses, or wet-weather seeps, an underdrain system consisting of <br />durable rock shall be constructed from the wet areas in a manner that <br />prevents infiltration of the water into the spoil materials. The <br />underdrain system shall be protected by an adequate filter and shall be <br />designed and constructed using standard geotechnical engineering methods. <br />Surface drainage in Area 1 comes from the large area to the south <br />and flows around the west flank of Pinnacle Peak.
