• <br />Section 816.62 Use of explosives: Pre-blasting survey. <br />(a) On the request to the regulatory authority by a resident or owner <br />of a dwelling or structure that is located within one-half mile of any <br />part of the permit area, the person who conducts the surface mining <br />activities shall promptly conduct a pre-blasting survey of the dwelling <br />or structure and promptly submit a report of the survey to the regulatory <br />authority and to the person requesting the survey. If a structure is <br />renovated or added to, subsequent to a pre-blast survey, then upon re- <br />quest to the regulatory authority a survey of such additions and reno- <br />vations shall be performed in accordance with this Section. <br />Energy Fuels will promptly conduct a pre-blasting survey upon re- <br />quest to the regulatory authority by a resident or owner of a <br />dwelling or structure located within one-half mile of any part of <br />the permit area. A report of the survey will be promptly submitted <br />to the regulatory authority and to the person requesting the survey. <br />A survey of any renovations or additions subsequent to a pre- <br />. blasting survey will be performed upon request to the regulatory <br />authority. <br />(b) The survey shall determine the condition of the dwelling or struc- <br />ture and document any pre-blasting damage and other physical factors <br />that could reasonably be affected by the blasting. Assessments of <br />structures such as pipes, cables, transmission lines and wells and <br />other water systems shall be limited to surface condition and readily <br />available data. Special attention shall be given to the pre-blasting <br />condition of wells and other water systems used for human, animal, or <br />agricultural purposes and to the quantity and quality of the water. <br />The pre-blasting survey will assess the condition of the structure <br />or dwelling and document any pre-blasting damage, including any <br />physical factors that might reasonably be affected by the blasting. <br />This survey will determine only the surface condition of pipes, <br />cables, transmission lines, and wells and other water systems; <br />816-71 <br />
