Section 816.57 (c) Continued. <br /> <br />examination not to meet the criteria of 30 CFR 816.57 (c) and <br />buffer zones have not been planned for these ephemeral drainages. <br />Field inspections described in Section 770.20 revealed areas in <br />intermittent and perennial drainages meeting the criteria of this <br />paragraph. These areas have been designated on the Energy Mines <br />No. 1 and 2 Mine Plan (Map 1) and Eckman Park Pfine Plan (Map 2) <br />as stream buffer zones. Ephemeral tributaries to these streams <br />were found not to require buffer zones for protection of biological <br />communities. <br />No land disturbance will occur within at least 100 feet on either <br />side of the intermittent and perennial streams qualifying for <br />buffer zones, with the following exceptions; five sedimentation <br />ponds, three haul road crossings and one haul road which encroaches <br />on a buffer zone, two access road crossings and the main loading <br />•) tipple at Energy Mine No. 1. The five sedimentation ponds within <br />buffer zones are Ponds A, B, C, D, and E identified on the Energy <br />Mines No. 1 and 2 Hydrology (Map 13). These ponds are required <br />for drainage and sediment control and were located so as to prevent <br />additional contribution of suspended solids in discharges from the <br />mine plan area into Foidel Creek. The haul roads which pass through <br />stream buffer zones are proposed haul roads which cross over or <br />parallel Foidel Creek or its tributaries. The haul road drainage, <br />culverts, and embankments described in Sections 780.11, 780.12, and <br />816.150-816.176, are designed to prevent adverse affects on water <br />quantity and quality to the extent possible. The access roads <br />which cross over Foidel Creek at Energy Pfine No. 1 are well main- <br />tained and have drainage and culverts designed for protection of <br />water quality and quantity, as demonstrated in the above referenced <br />Sections. These roads are located as follows: 1) The NE1/4 of <br />SE1/4, Section 13, T4N, R76W and the SW1/4 of NW1/4, Section 18, <br />T4N, R86W; 2) SW1/4 of NE1/4, Section 31, TSN, R86W; 3) NE1/4 of <br />._ <br />816-68 <br />
